Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the PostPilot mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). The App is operated by BorstPhoto, LLC (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.

2. Description of Service

PostPilot is a social media scheduling and publishing tool that helps you manage content for your own Facebook Pages and Instagram professional accounts, providing:

• Connecting the Facebook Pages and Instagram accounts you manage
• Composing, scheduling, publishing, and deleting posts
• Uploading photos and videos to attach to your posts
• Viewing engagement metrics for the content you publish

PostPilot acts on your behalf and only with the accounts you explicitly connect and authorize through Facebook Login.

3. Eligibility & Access

You must be at least 13 years of age to use the App. To publish content, you must connect a Facebook Page or Instagram professional account that you own or are authorized to manage. Your access to the App is tied to your authenticated account (via Apple Sign-In) and the access tokens granted when you connect your Meta accounts. You may revoke that access at any time.

4. Account Security

You are responsible for maintaining the security of your device and authentication methods used to access the App. You agree to:

• Keep your device and sign-in credentials secure
• Notify us immediately of any unauthorized access to your account
• Only connect Facebook Pages and Instagram accounts you are authorized to manage
• Not attempt to access other users’ data or circumvent security measures

5. Your Content & Responsibilities

You retain ownership of the content you create and publish through the App. By using the App, you acknowledge that:

• You are solely responsible for the content you publish and for ensuring you have all necessary rights to publish it
• Your published content must comply with the terms and policies of Meta (Facebook and Instagram), including their Community Standards
• You grant us the limited permission to transmit and publish your content to your connected accounts solely to provide the service
• The App itself, including its design, code, and branding, is the property of BorstPhoto, LLC and is protected by copyright and trademark law

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Publish content that is illegal, defamatory, obscene, harassing, or that infringes the rights of others
• Publish spam, phishing, malware, or fraudulent or misleading content
• Violate the terms, policies, or Community Standards of Meta or any connected platform
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App’s infrastructure, or scrape or harvest data through automated means
• Connect or publish to accounts you are not authorized to manage

7. Third-Party Services

The App integrates with third-party services including Apple Sign-In, Meta (Facebook and Instagram), and Supabase. Your use of these services is governed by their respective terms and policies. We are not responsible for the content, practices, or availability of third-party services, including any changes Meta makes to its APIs that may affect App functionality.

8. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the delivery, timing, reach, or performance of any content published through the App, as these depend on third-party platforms outside our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BorstPhoto, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. This includes, but is not limited to, failed or delayed posts, loss of content, or interruptions in service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for services in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless BorstPhoto, LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the App, the content you publish, or your violation of these Terms.

11. Account Termination

We may suspend or terminate your access to the App at any time, with or without cause. You may delete your account at any time through the App’s Settings screen. Upon account deletion, your data will be permanently removed in accordance with our Privacy Policy and Data Deletion policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Jefferson County, Kentucky.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated “Last updated” date. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
