1. Introduction

This SMS Privacy Policy describes how BorstPhoto, LLC (“we,” “us,” or “our”) collects, uses, and protects information related to our SMS and text-message program (the “Program”), which is delivered through Twilio Inc. as our messaging service provider. This policy applies only to information collected through the Program. Use of any other service we operate is governed by the policy listed for that service.

We do not sell, rent, trade, or share your information with third parties for marketing or promotional purposes. Phone numbers and SMS opt-in data are never shared with third parties or affiliates for their own marketing purposes.

2. Information We Collect

In connection with the Program, we collect only the information necessary to deliver messages and operate the service:

  • Mobile phone number — provided by you at the time you opt in.
  • Opt-in record — the date, time, source, and method by which you provided consent to receive messages.
  • Message content and metadata — the text of messages sent to and from your number under the Program, along with delivery status and timestamps generated by Twilio.
  • Opt-out record — if you reply STOP or another opt-out keyword, we record that your number has been unsubscribed and the date and time of that request.
  • Name and account identifier, where applicable — to associate the phone number with your account so that messages relate to the correct booking, appointment, or support ticket.

We do not collect device location, contact lists, browsing history, advertising identifiers, or any other data through the Program.

3. How We Use the Information

We use information collected through the Program only to:

  • Send the message categories described in our SMS Terms of Service (account notifications, transactional updates, appointment reminders, and customer support replies).
  • Verify your identity through one-time codes or two-factor authentication you have requested.
  • Maintain a record of your opt-in and opt-out status to comply with applicable telecommunications regulations.
  • Investigate and respond to support requests you initiate.
  • Detect and prevent fraud, abuse, or violations of our terms.

4. Sharing of Information

We do not sell, rent, lease, trade, or share your phone number, opt-in status, or message content with third parties for marketing purposes. The only parties that receive Program data are:

  • Twilio Inc. — our messaging service provider, which transmits messages on our behalf and is bound by its own privacy and security obligations.
  • Wireless carriers — the mobile networks involved in delivering each message between Twilio and your device.
  • Law enforcement or regulators — only when required by valid legal process, subpoena, court order, or applicable law.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories described above — including SMS opt-in data — are excluded from any third-party sharing for those purposes.

5. Data Security

Phone numbers and message records are stored on secured systems with access restricted to authorized personnel. Data transmitted between our systems and Twilio is encrypted in transit using TLS, and stored data is encrypted at rest. We use commercially reasonable administrative, technical, and physical safeguards to protect Program information from unauthorized access, alteration, disclosure, or destruction.

6. Data Retention

We retain Program data only as long as needed to operate the service and to comply with our legal obligations:

  • Active subscriber phone numbers and opt-in records are retained for as long as you remain opted in.
  • Opt-out records are retained indefinitely so we can honor your request and demonstrate compliance.
  • Message content and delivery logs are retained for a limited operational period (typically up to 12 months) and then deleted or anonymized, unless a longer period is required for legal, accounting, or dispute-resolution purposes.

7. Your Choices & Rights

You have the following rights regarding Program data:

  • Opt out at any time. Reply STOP to any message to stop receiving Program messages. STOP, END, CANCEL, UNSUBSCRIBE, and QUIT are all recognized.
  • Help. Reply HELP for support information, or contact us using the details in Section 10.
  • Access & correction. You may request a copy of the Program information we hold about you, or ask us to correct it, by contacting us.
  • Deletion. You may request that we delete your phone number and Program records, subject to limited exceptions for opt-out tracking and legal compliance.

8. Children’s Privacy

The Program is not directed to children under 13, and we do not knowingly enroll children under 13. If we learn that we have collected information from a child under 13 in connection with the Program, we will delete it promptly.

9. Changes to This Policy

We may update this SMS Privacy Policy from time to time. Changes are effective upon posting to this page with an updated “Last updated” date. Material changes that affect how we use Program data will be communicated to active subscribers.
