Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ClientKeeper mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). The App is operated by BorstPhoto, LLC (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.

2. Description of Service

ClientKeeper is a client portal application that provides authorized clients of BorstPhoto, LLC with access to their content protection account data, including but not limited to:

• URL tracking and removal status
• DMCA takedown notice history
• Search engine deindex reports and requests
• Secure messaging with your assigned account team
• Billing and subscription management
• Monthly activity reports
• Letter of Authorization (LOA) management

3. Eligibility & Access

The App is available exclusively to active clients of BorstPhoto, LLC with a valid service agreement. Access is granted through an email-based verification system. You must be at least 18 years of age to use the App.

Your access to the App is tied to your active client account. If your service agreement with BorstPhoto, LLC is terminated for any reason, your access to the App will also be terminated.

4. Account Security

You are responsible for maintaining the security of your device and any authentication methods (including biometric sign-in) used to access the App. You agree to:

• Keep your email access secure, as it is used for authentication
• Notify us immediately of any unauthorized access to your account
• Not share your login codes or allow others to access the App using your credentials
• Not attempt to access other clients’ data or circumvent security measures

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App’s servers, networks, or infrastructure
• Scrape, harvest, or collect data from the App through automated means
• Impersonate another person or misrepresent your identity
• Use the App to transmit malicious code, spam, or harmful content

6. Intellectual Property

The App, including its design, code, graphics, and content, is the property of BorstPhoto, LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose as a client portal.

Content displayed within the App that relates to your case (URLs, notices, reports) is managed data associated with your service agreement and is subject to the terms of that agreement.

7. Push Notifications

The App may send push notifications regarding takedown updates, deindex status, messages, and other account activity. You can manage notification preferences through your device’s Settings. Opting out of notifications does not affect the delivery of services.

8. Third-Party Services

The App may provide links to or integrate with third-party services (such as Stripe for billing). Your use of such services is governed by their respective terms and policies. We are not responsible for the content or practices of third-party services.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding the accuracy or completeness of data displayed in the App, though we strive to keep it current.

10. Limitation of Liability

To the maximum extent permitted by applicable law, BorstPhoto, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for our services in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BorstPhoto, LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the App or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Jefferson County, Kentucky.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated “Last updated” date. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
